| | | The court said that Gilani has been ineligible since April 26 when the court had announced the verdict in contempt case against the Prime Minister.
“Yousuf Raza Gilani is disqualified from membership of parliament from April 26, the date of his conviction. He has also ceased to be the prime minister of Pakistan,” said Chief Justice Iftikhar Mohammad Chaudhry, reading the order.
National Assembly Speaker Fehmida Mirza had contended that she had absolute power to decide the matter regarding the disqualification or qualification of any lawmaker after the passage of the 18th Amendment.
A three-member bench, comprising Chief Justice Iftikhar Mohammad Chaudhry, Justice Jawwad S Khawaja and Justice Khilji Arif Hussain declared Mirza’s ruling as void.
The bench had been hearing a set of petitions filed by the Pakistan Muslim League-Nawaz (PML-N), the Pakistan Tehrik-i-Insaf (PTI), Azhar Chaudhry advocate and others challenging Mirza's ruling of May 24.
